Who Needs to Pay Provisional Tax? A Guide from Iliossa

At Iliossa, we believe in providing clear and principled guidance when it comes to your tax responsibilities, all rooted in biblical values of stewardship and integrity. One of the most common areas of confusion is provisional tax—who is required to pay it, and how it works. Let’s walk you through this important topic.

What is Provisional Tax?

Provisional tax is a method of paying your income tax in advance. Rather than waiting until the end of the tax year to settle your tax bill in one large sum, provisional tax allows you to make payments throughout the year. This system aligns with the principle of financial stewardship—paying in manageable amounts and avoiding the burden of a large sum due all at once.

But who exactly needs to pay provisional tax?

Who is Required to Pay Provisional Tax?

According to SARS, you are a provisional taxpayer if you earn income other than a salary that is subject to PAYE. While salaried individuals have their taxes deducted automatically through PAYE, those who have additional or alternative sources of income need to take a proactive approach to paying tax. Here are common examples of people required to pay provisional tax:

  1. Freelancers and Small Business Owners: If you run your own business or work on a freelance basis, your income is not taxed at the source. Therefore, you are required to estimate your annual taxable income and make provisional tax payments.
  2. Landlords and Property Investors: If you earn rental income from properties, even if you also receive a salary, you may need to register for provisional tax.
  3. Investors: Earning significant income from interest, dividends, or other investment income can make you liable for provisional tax, especially if this income exceeds R30,000 per year and your total taxable income exceeds the SARS threshold.
  4. Trust Beneficiaries: Income from trust distributions, particularly from investment earnings, can also trigger provisional tax liability.

Is Provisional Tax Automatic?

One of the questions we often get asked is whether provisional tax is automated. The short answer is no—it’s not automatic. Unlike PAYE, which is deducted directly from your salary by your employer, provisional tax is based on self-assessment and requires you to take responsibility for estimating your income and filing returns twice a year (with an optional third payment). This method ensures that your tax liability is spread out across the year, avoiding a heavy tax burden when filing your final return.

For companies, registration for provisional tax is automatic. However, for individuals, the onus is on you to determine whether you qualify as a provisional taxpayer and to file your returns on time.

Key Steps for Provisional Tax

Here’s how you can manage provisional tax:

  1. Estimate Your Taxable Income: You need to estimate your taxable income for the year and file an IRP6 return, which can be done easily via SARS eFiling. This return must be submitted twice during the year of assessment—at the end of August and at the end of February.
  2. Make Payments: Based on your estimate, you will pay a portion of your tax in advance, reducing your overall liability at the end of the year.
  3. Optional Third Payment: If your income has been higher than expected, you can make an additional, voluntary payment in September after the tax year ends, ensuring your payments match your final taxable income.

Why It’s Important

As with everything in financial stewardship, being proactive is key. Failure to pay your provisional tax on time or underestimating your income can result in penalties from SARS. At Iliossa, we guide our clients to ensure their tax affairs are handled with diligence and in a manner that honors their commitments. The Bible speaks to this in Romans 13:7: “Give to everyone what you owe them: if you owe taxes, pay taxes…” Provisional tax helps prevent the sudden burden of owing a large sum at the end of the tax year, allowing you to meet your obligations responsibly.
